Members of the Association are individuals who left FR of Yugoslavia prior to, or during the recent Kosovo crisis and NATO operations, in order to avoid being drafted into armed forces or those who deserted Yugoslav Army pursuant to their genuine conscious convictions and beliefs. The return of these people to their country would result in arrest and many years of imprisonment in Yugoslav prisons.

Legitimate claims of these individuals to be granted refugee status in Hungary are grounded on justified fear of persecution on account of religious and political convictions.

The right to objection by conscience is the basic component of the right to freedom of thought, conscience and religion – as clearly stated in General Declaration of the Human Rights, International Agreement on Civil and Political Rights and European Convention on Human Right. It is also recognized as being such in resolutions and recommendations accepted by the United Nations Committee for Human Rights, European Council and European Parliament.

The basis for granting asylum is found in the Handbook on Procedures and Criteria to Determining Refugee Status (1979) issued by UNHCR, stating that: „Where, however, the type of military action, with which an individual does not wish to be associated, is condemned by the international community as contrary to basic rules of human conduct, punishment for desertion or draft-evasion could, in the light of all other requirements of the definition, in itself be regarded as persecution.” (Chapter V, Section B, Paragraph 171) Temporary protection measures do not provide any substantial support whatsoever to these people.

A necessity to secure appropriate protection to those who chose rather to leave their own country than to take part in internationally condemned conflicts has not merited a priority. These people live in miserable conditions in refugee centers and camps or inadequate private accommodation with no guaranty for their long-term security, always facing a possibility of imprisonment sentences if they return to Yugoslavia. In addition to claiming refugee status, NGO Seobe99 wishes to build the bridges of trust with all nations and spread the culture of peace and non-violence.
